I have repeated that and that I can explain my position. I haven't explained my position because it was you who had made such an issue of it, which prompted me to initiate this strand of discussion. If you like my explanations you may feel free to adopt them. I don't need to go back, I am always forward looking and liberal in my thinking, in that regard. In any event, it is definitional.

A just outcome in practical matters: Justice in our society is a term used to describe the condition which is met when wrongs are righted and reasonable human beings can be reconciled in circumstance. It is also a term used to describe circumstance at a point in time where associated concerns are considered resolved. So, a just outcome should be fair, resolute, and reconciliatory.

I have also defined justice in the ideal sense, which is too metaphysical to apply to this discussion. Perfect justice occurs when everyone's needs are met simultaneously and absolutely. Some people believe this is the case ... not an argument I want to engage in.

A just outcome for any heinous crime should be the maximum penalty. We have a problem with the current legal definition of Heinous Crime, which includes everything from brutal rape and murder to bribery and drug offenses. It is no wonder the justice system is conflicted and ineffective.

Heinous crime needs to be taken more serious, starting with simplifying the legal definition. Then we can do a better job determining reliable consequences (maximum penalty) for heinous crime which are fair and resolute.

There must be a compelling reason to label something as a heinous crime deserving of the maximum penaltyt.

I am starting by redefining heinous crime: A heinous crime is so because it is unquestionably so odious and cruel or malicious in nature as to be irreconcilable.

Life without parole for heinous criminals should include the separation from the general population of criminals since the latter are still considered members of society.

These are the underlying criteria, which result in a complete and irreversible separation from society. It is in many ways a virtual death. To me it seems like a fate worse than death, yet fair and resolute in all cases of Heinous Crime as I have defined Heinous Crime.

Loss of liberty. They are no longer at liberty to engage other members of society. By the nature of the crime, they have separated themselves from society and all privileges and benefits otherwise available to members of society.

Protection for members of society. Members of society must be protected from any engagement or impacts from Heinous Criminals. The state has an obligation to block heinous criminals from such engagement.

Humane treatment: Humane treatment is considered according to the context of specific treatment(s). And there must be some positive obligation to provide treatment of any sort. Rehabilitation is no longer a consideration nor is providing societal privileges and benefits. Humane treatment in this case involves a prohibition against ill treatment such as: Torture, Cruelty, Degrading treatment, physical punishment, medical or scientific experimentation, hardship or constraint other than that resulting from loss of liberty and except those unavoidable due to being placed in a closed environment or resulting from their separation from society.
