In the 1970s, the BIA codified what it required to identify someone as a native american. You had to be at least 1/32 of native american ancestry. By that measure, Warren complies. Harvard touted that for a period of time. However, there is no proof she ever claimed to be a native american, just that she had some as ancestors. In the Senate race with Brown, he tried to claim that she took advantage of that fact to her professional advancement. Despite there being no indication that actually happened, he never managed to make the charge stick. The Republicans are still trying to use that against her.
