We're (technically, altho not declared) at war with AQ and the Taliban. He was held against his will; tried to escape at least once.

USG policy is to not pay. Family and friends can negotiate. They might run afoul of the law; or not. I think Uncle Sam turns a blind eye to private deals.

Yes, if he was civilian and not military, he would be a hostage.

Just to complicate things, I think a member of the military kidnapped by Mexican/Central American drug gangs would be a hostage, not a POW.
