I don't know, but I'm willing to bet real money that the Apple lawyers can come up with one.
I'd be interested in the other side of that bet. Of course, you can sue someone for anything, but there's not remotely a basis that would get anywhere, and that's presuming that the conspiracy theorists are correct.

I can't even find that demonstration on cnn.com.
Here it is. Laughable, as he completely misses the point. The worry isn't that people will try to bend it purposefully, nor that simply sitting/standing/kicking with it in a loose pocket will cause issues. It's when you put stress on it within a tight pocket, getting it wedged somewhere and needing to put a little force on it to get it out, etc. that it will gradually warp over time. My favorite part is how meekly he attempts to bend it... I'm not sure he would have bent a drinking straw that way :)
