Kimberley: Phoenix/Omega received 1 million IPM shares in about April or May which had no restrictions, to my knowledge. If no restrictions, they could have been sold any time since. They also received 3 million? shares as security for the $16.5? million cash payment (not counting all of the interest and penalties) which has yet to be made. Since the amended agreement between IPM and Phoenix/Omega expired October 15, and no new deal has been announced, it is also quite possible that Phoenix/Omega is free to sell these 3 million shares as well (if they already haven't).
