Well if this is the case then his civil suit will be thrown out for the following reasons.

Case EDCV-97-300 RT (VAPx)
page 5, line 12. Paragraph 22 is the preliminary allegations section of his compaint states that he sold 100,000 shares of OVIS (now RMIL) on the behalf of Michael Zapara.

page 8, line 27, paragraph 32 states that in June and July 1997 Michael Zapara induced PLANITIFF to sell 100,000 shares of OLYMPUS/ROCKY Mountain stock in the PLANTIFF's name on behalf of Michael Zapara.

Also Michael Zapara is only mentioned in the complaint and not named as a defendant. In my opinion this is a grounds to throw this SLAP suit out also, as the original reason for MORK's suit has to do with the ALLEGED COLLUSSION with Michael Zapara.
