The company filed a voluntary bankruptcy petition, so the current management will remain in place unless the bankruptcy judge decides otherwise. I suspect that the "settlement" was negotiated between the attorneys for Apple and GTAT. One of the article that you posted noted that a creditor's committee had already been appointed to represent the interests of the creditors. At some point a similar committee (or attorney) will be selected to represent the interests of the shareholders. That may have already happened.
