"So if an attacker causes the death of a fetus it is the murder of a human being, but if the mother has her unborn child killed, then it's not a human being" Society has decided that all persons have the same fundamental rights and that for this premise to be correct a fetus cannot be deemed a person. I see nothing wrong with the woman putting her own value on her property. That is really what the right to abort means. There are wanted pregnancies and there are unwanted pregnancies. I think it is obvious that the fetus has no legal status and ought not to have any legal status while within the mother. "Personhood is an arbitrary philosophical and legal term.." Arbitrary, no. Controversial and complicated, yes. The problem with defining personhood is overly complicated by religious organizations introducing "arguments" which have no basis in fact and thus deflect and obscure the issues and derail legitimate enquiry. Canadian Law has done a good job of protecting a mother's right to her property as well as her right to abort. "A child becomes a human being within the meaning of this Act when it has completely proceeded, in a living state, from the body of its mother, whether or not (a) it has breathed; (b) it has an independent circulation, or (c) the navel string is severed." "A person commits homicide when he causes injury to a child before or during its birth as a result of which the child dies after becoming a human being." I don't think this latter clause was designed to imply any legal status to a fetus. Rather, it seeks to prevent and to punish the actions of any person interfering with the woman's pregnancy. A woman has a right to give birth. The fetus is her property. The entire abortion debate should be restructured around the right to property. This would clarify matters a great deal.
