As previously stated, never in the context of a law raising 100s of billions of dollars. That is not "incidental," and the Court certainly shouldn't hold that it is.

And we currently have a split in the 5th & 9th circuits which will persist after the 9th Circuit rules en banc.

At the very least it is going to pose a meaningful threat to the law, although a year or two off.
