NODAWAY COUNTY, Mo. – A homeschooling family has filed a federal civil rights lawsuit after they say their home was illegally searched by the sheriff’s department.


The Home School Legal Defense Association is aiding Laura and Jason Hagan. Their house was raided by Nodaway County Sheriff Darren White and Chief Sheriff’s Deputy David Glidden.

According to the HSLDA, “child protective services (CPS) caseworker had been inside the home several days earlier to investigate a report of a messy house and had returned for a follow-up visit.”

When they declined to let her in, the CPS worker summoned the sheriff.

They, too, sought to get in the house but they didn’t have a court order and Hagan declined their request.

Then, according to HSLDA:

As Jason turned to go back inside, Glidden sprayed him with pepper spray—first at the back of his head and then directly in his face. Glidden also sprayed Laura, who fell to the floor. Glidden then turned to Jason, who was still standing, and shot him in the back with his Taser. As Jason fell, Laura closed the front door. Glidden triggered the Taser three more times through the closed door.

Sheriff White joined Glidden on the front porch. Together they forced open the door and found Laura and Jason lying on the floor. Glidden sprayed Laura in the face a second time while White sprayed Jason and tried to turn him over onto his stomach.

Laura shouted to the officers that Jason had been taken to the emergency room earlier in the week for chest pains. White nevertheless continued attempting to turn Jason over and sprayed him a third time when he was unsuccessful. The officers also sprayed the Hagans’ dog with chemical agent and threatened to shoot it if it didn’t stop barking.

Finally, the officers handcuffed and arrested Laura and Jason and charged them with resisting arrest and child endangerment.

All of this took place in front of the Hagans’ three young children, who were then taken to the emergency room to be evaluated for exposure to pepper spray.

This all took place on September 30, 2011.

Because of the warrantless search, the judge dismissed the case against the Hagans.

“The State has not offered sufficient, if indeed any, evidence of an exception that would justify a warrantless entry,” the judge wrote in his ruling, according to the home school group.

The HSLDA filed suit in federal court on November 14, 2014, alleging White and Glidden violated the Hagans’ Fourth Amendment rights.

“All too often, law enforcement officers and child-welfare workers act as if the Fourth Amendment does not apply to CPS investigations. They are wrong. The Fourth Amendment is a legal shield that protects people from exactly the kind of mistreatment the Hagans endured,” the organization writes.

Wilson received death threats after he was identified as the officer who shot Brown, and as community members and activists plan to protest if he is not indicted, the location of his home could potentially endanger him, his new wife, and his property if the protests result in violence, some of his defenders say. Wilson’s home address is a matter of public record, and it has been published in numerous media reports beginning in August. But printing his street name in the nation’s most influential newspaper on the day the grand jury is expected to hand up a decision on the indictment could reignite interest in -- and awareness of -- the location, and some critics worry that it could result in protesters descending on his home. Slate even went a step further than the Times, publishing an article featuring a photo of the modest, red-brick house on Monday.

A number of Twitter users -- some of whom have identified themselves as planning to protest the grand jury decision -- have tweeted the location of Wilson’s home as they gear up for rallies. The house number was not printed in the Times, but the street in the St. Louis suburb of Crestwood where it sits is only about two blocks long, and the house number can be easily located via online sources using only the street name and Wilson’s name.

The Times reported that Wilson and his new wife, fellow Ferguson Police Officer Barbara Spradling, have avoided the home for months. “They have scarcely been seen there since Mr. Brown was killed on Aug. 9,” the Times reported in the Monday article that included the street name. “Neighbors said that within a few days of the shooting, Officer Wilson and Officer Spradling abruptly left their home.”

Every cop in America knows one thing – it could have been him.

Or her.

It could have been him or her, instead of Darren Wilson, who pulled that trigger on Michael Brown.

Or some such similar young man.

Every cop in America knows that, in return for choosing a career in law enforcement, the rules of the road are now that, at any minute, it all could be over and you could become hated and condemned all across the country.

No one would have your back, even the president could denounce you.



Because you defended yourself.

In a twist on biting the hand that feeds you, we are instead tying the hand that defends us. We are sending them out, and waiting for the first chance to gut them.

It is an incomprehensible act of ingratitude.

All across American law enforcement, officers know that the new reality facing them when they pull their guns is: By defending myself, I could be condemning myself.

Take Darren Wilson.

A good cop on routine patrol. He’s coming back from a call and has brief contact with two individuals. Nothing comes of it until he moves a ways down the block and gets a radio description of a wanted individual matching one of the young men he’s just seen.

Rolling back up on the two individuals, the larger of them – Michael Brown – lunges into the driver’s window of the squad car and begins assaulting Darren Wilson. Michael Brown then tries to take away the officer’s gun.

The officer gets off a round, Michael Brown attempts to flee, and then charges at the officer, twice, before being shot to death.

In the mind of witnesses and Darren Wilson, Michael Brown was set to attack and was an immediate threat to the life of Officer Wilson.

So Officer Wilson did what his training taught him to do. He did what instinct, morality and the laws of men command him to do – he defended himself.

And his life is ruined.

His career is over, his family is threatened, his name is destroyed, he has been vilified across the country and by the nation’s most prominent voices.

People have rioted demanding imprisonment for him, and there have been countless threats on his life.

His life, as he knew it, is over.

Because he was a cop and he defended himself.

An entire society has forgotten that Darren Wilson is not the perpetrator of a crime, he is the victim of a crime.

Likewise, it has been forgotten that Darren Wilson was an officer of the law with a duty to act, and that he was on patrol that day in the name and service of the people.

And it is dispiriting to see how instantly the people have turned on him and his profession.

You get up in the morning and put on a uniform that carries with it the obligation to potentially die in the service of your community, to put yourself between the good people and whatever species of hell pops up, and then, when you are literally fighting for your life and the community’s protection, nobody has your back.

Everybody curses your name.

Millions hate you.

Much of the nation turns against you.

In the matter of some 20 seconds.

Damned if you do, dead if you don't.Every cop in America wakes up every day knowing that that could be his fate. By the happenstance of random probability, the unpredictability of criminality, some wild hare seizing upon who knows what thug, and that could be you.

And it wouldn’t matter who you were, or what good you had done, or how many years you had served, or what you had made of your life and to what good cause you had dedicated it.

Al Sharpton would be yelling your name, mobs would be burning your effigy, and the president would be undercutting your profession.

And who wants that?

What kind of person, having seen on the nation’s newscasts the destruction of Darren Wilson, wants to risk that?

How many law enforcement officers will think of the danger associated with their thankless job, see the risk facing themselves and their family, recognize that it is completely unfair and wrong, and quit?

How many will lay down their badge and their career and walk away?

Probably none.

Because that’s the kind of people most of them are. They press on. They do their duty. They don’t quit.

That’s who they are.

More at issue is: Who are we?

Are we the kind of society that looks on and does nothing, or are we the kind of society that values law enforcement and what it does, and has its back?

Are we the kind of society that can look at the matter in Ferguson and push back the anti-cop prejudices and honestly consider the situation of Darren Wilson? Can we recognize the injustice of his situation?

Not that he wasn’t prosecuted, but that he was ever suspected. That an officer of the law, the victim of a violent and felonious attack, can be forced into a fight for his life, and then be condemned for winning.

Would society have preferred he die?

We all know that if the cop had died, instead of the guy who attacked him, that none of us would have ever heard of this.

The president wouldn’t have commented, the nation wouldn’t have noticed, nobody would have given a damn.

Dead cop, no problem.

Dead thug, raise holy hell.

And every cop knows that.

And carries that sad realization 24 hours a day.

The president said we need to train our police better. Maybe we need to train our society better.

Maybe we should train the Michael Browns of the world to respect the law, and maybe we should train the rest of us to respect the law enforcers.

And have their backs.

Or at least understand the horrible risk and reality Ferguson creates for them.

Because every cop knows today could be his day.

Julie Bosman “keeps calling the 020th District station complaining about people harassing and threatening her,” our source told us. She’s also “complaining about numerous food deliveries being sent to her residence.”

Chicago police department sources alerted Gotnews.com about the glaring double standard on Friday.

Charles Johnson, Editor-in-chief of GotNews, filed a lawsuit in St. Louis seeking the release of Michael Brown’s juvenile criminal record, claiming they no longer need to be kept private. Johnson says law enforcement told him that Brown’s juvenile arrest record contains a second-degree murder charge and information linking him to the notorious Crips street gang.

“To find out if those police officers are correct requires seeing Brown’s juvenile arrest record, which ought to be freely available given that he is dead and therefore has no right to privacy remaining,” insists Johnson.



“Knowing the truth about Brown’s past will help us gauge the credibility of his parents and family who have called him a ‘gentle giant.'”

Attorney Johnathon Burns, who is arguing the case, told KMOX that since the teen is deceased, his records are no longer sealed.

Nation of Islam leader Louis Farrakhan went on a fiery tirade about Ferguson on Saturday — threatening that if the demands of protesters aren’t met, “we’ll tear this goddamn country apart!” Farrakhan stated in his speech — given at Morgan State University, a black college located in Baltimore, Md. — that violence was justified in response to the decision not to indict officer Darren Wilson and peaceful protests are only in the interest of “white folks.”

“We going to die anyway. Let’s die for something,” the radical figure told the crowd to roaring applause.

He even said the parents of teenagers should teach their kids how to throw Molotov cocktails. “Teach your baby how to throw the bottle if they can. Fight,” the minister advised, and then imitated throwing the explosive device.

Farrakhan argued that violence was justified by the “law of retaliation” HE claims is in both the Bible and the Koran.

“In this book, there’s a law for retaliation,” he said, while holding up what appeared to be the NOI version of the Koran, and repeated, “A law for retaliation.”

Farrakhan believes white people will only start listening to black concerns through violence against whites.

“As long as they [whites] kill us [blacks] and go to Wendy’s and have a burger and go to sleep, they’ll keep killing us,” the self-proclaimed minister said. “But when we die and they die, then soon we’re going to sit at a table and talk about it! We’re tired! We want some of this earth or we’ll tear this goddamn country up!”

Farrakhan also criticized President Barack Obama, U.S. Attorney General Eric Holder and other black leaders for engaging in what he sees as “compromise” and being out of touch with young African-Americans. He believes they are doing the bidding of “white people” by trying to tell protesters in Ferguson to remain calm.

“Tonight in Ferguson everybody is on edge. White folks have never been on edge after they killed a Black man. Tonight they’re on edge; so on edge that our president has come out from behind the curtain to ask young Black people: ‘Cool it. That’s not our way.’” Farrakhan said. “I heard you, Mr. President; and I asked myself a question: What brings you out of the shadows?”

Farrakhan then attacked Eric Holder and black religious leaders for telling “black youth to be peaceful.”

“And you preachers: Your day of being the pacifier for the white man’s tyranny upon black people, you got to know they’re [young blacks] not going to hear you anymore!” Farrakhan declared to standing ovations.

He continued to go after Obama and how he has not gone to “wicked” police departments and demanded they stop killing minorities.

“Why the hell don’t you stand up and tell them that your killing of Black youth and Brown youth is not going to hold no more,” Farrakhan said.

Despite wanting violent confrontations in the area, Farrakhan wrongly referred to Ferguson as “Jefferson” in some of his remarks and only corrected his mistake when audience members shouted out the town’s actual name.

FERGUSON, Mo. (CBS St. Louis/AP) – Ferguson Police Chief Tom Jackson indicated that they are “pursuing” an investigation into whether comments made by Michael Brown’s stepfather the night Ferguson officer Darren Wilson was not indicted by a grand jury incited a riot.

Following the announcement of the grand jury’s decision Nov. 24, Louis Head was caught on camera yelling, “Burn this motherf***** down! Burn this bitch down!”

Violent protests broke out following the decision, as dozens of buildings and businesses were looted and set fire.

Appearing on Fox News, Sean Hannity asked Jackson if Head’s comments helped incite a riot and were being pursued by law enforcement.

“We are pursuing those comments and there’s a lot of discussion going on about that right now,” Jackson told Fox News on Monday.

Missouri Lt. Gov. Peter Kinder told Fox News that it sounds like Head was trying to incite a riot.

“It sure sounds that way to a lot of folks, but that’s a decision for the authorities to make,” Kinder said.

Kinder also criticized President Barack Obama for allowing Rev. Al Sharpton into his inner circle.

“I cannot imagine any previous American president, of either party, welcoming an inciter of mobs like Rev. Sharpton into the White House, into his inner councils, for sober advice.

“It’s just wrong to have a man with Sharpton’s background … into such privileged councils.”

In terms of those who rioted, Jackson is hoping to identify each one in an effort to prosecute.

“We can’t let all that happened in Ferguson … die. Everyone who is responsible for taking away people’s property, their livelihoods, their businesses, every single one of them needs to be prosecuted to the fullest extent of the law,” Jackson said.

Wilson resigned from the Ferguson Police Department over the weekend after less than three years on the job. He did not receive a severance package.

Wilson wrote in his resignation letter that his “continued employment may put the residents and police officers of the city of Ferguson at risk, which is a circumstance I cannot allow.”

His lawyer, Neil Bruntrager, told The Associated Press that Wilson decided to step aside after Jackson told him about the alleged threats on Saturday.

“The information we had was that there would be actions targeting the Ferguson (police) department or buildings in Ferguson related to the police department,” Bruntrager said.

He said Wilson, who had worked for the department for less than three years, and the city were already discussing an exit strategy, acknowledging that Wilson staying on as an officer there would be impossible.

Many have criticized the authorities’ handling of the case, but Ferguson Mayor James Knowles said no leadership changes were in the works. Asked if he would resign, Jackson said flatly, “no.”

Wilson has spent his career as a police officer, first in neighboring Jennings, then in Ferguson. Bruntrager said it’s all he’s ever wanted to do.

“In terms of what it (the resignation) means, it means at this point he doesn’t have a paycheck,” Bruntrager said. “He has no income so he’ll have to make some decisions pretty quickly.”

Wilson fatally shot Brown in the middle of a Ferguson street after the two scuffled inside Wilson’s police SUV. Brown’s body was left for more than four hours as police investigated and angry onlookers gathered.

Some witnesses have said Brown had his hands up when Wilson shot him. Wilson told the grand jury that he feared for his life when Brown hit him and reached for his gun.

The U.S. Justice Department is conducting a civil rights investigation into the shooting and a separate investigation of police department practices. It isn’t clear when those results will be announced.

After the grand jury’s decision was announced, 12 commercial buildings in Ferguson were destroyed by fire. There have been well over 100 arrests at St. Louis-area protests in that time.

Knowles said there hasn’t been a cost assessment of the damage in Ferguson yet, and he promised residents and businesses that the city will do all it can to seek financial help.

“We are committed to rebuilding our city,” he said.

Attorney General Eric Holder is guilty of race-bait tactics in his response to Ferguson, said Milwaukee’s widely quoted and tough-talking black sheriff, David Clarke, in a recent nationally televised interview.

“He comes out with these scurrilous claims that law enforcement officers hit the streets every day with some nefarious intent in their heart to deny people their constitutional civil rights and indiscriminately just shoot black males as if it were some sort of sport,” Sheriff Clarke said in an interview on “The Kelly File” on Fox News.

Taking the Ferguson riots as cause to issue new federal guidelines against racial profiling is an over-the-top reaction to Ferguson, Sheriff Clarke said, adding that Mr. Holder’s actions have “disgusted” him.

“He knows how due process works,” Sheriff Clarke said, Newsmax reported. “He knows what justice is. He claims he wants justice for all, but apparently he doesn’t want justice for police officers.”Sheriff Clarke also added that Mr. Holder left “a sour taste in the mouths of all law enforcement officers” by suggesting that racial bias was a big part of modern day policing, Newsmax reported.

Sheriff Clarke made the statements in context of discussing the fallout from the grand jury’s decision not to indict Ferguson Police Officer Darren Wilson in the Aug. 9 shooting death of teen Michael Brown. The tough-on-crime sheriff also criticized the Congressional Black Caucus, and decried members’ claim that the grand jury determination only proved that “black lives don’t matter” in the United States, and rebuked the White House for fueling racial animosity, Newsmax reported.

“That [race] wound has been opened again, and some of it is because of the divisive politics that the White House has been playing,” Sheriff Clarke said, Fox News reported.
