I don't think there is general agreement that an argument in favor of torture is impossible. I would agree that the applications are few and far between.

But consider the so-called "ticking time bomb" problem. In that instance, pretty much anyone will opt for torture -- even John McCain has said that in those circumstances you "do what you have to do." And Ms. Feinstein would as well, although you'd never get her to admit it now (she DID know about the waterboarding before the fact and chose not to make anything of it then).

Most people I know, regardless of political belief, would choose to apply torture to save the life of a family member. While these personal situations don't arise in the lives of most people, at the time when waterboarding was carried out it WAS effectively a "ticking time bomb" situation.

I'm sure you've seen the story of the young girl in Mississippi who was burned to death recently. I would not blame those parents for wanting torture as revenge for that killing.

The circumstances that warrant mild forms of torture -- which might be how someone would think of waterboarding -- are rare but they do exist. Given where the nation is politically, I don't think it should be codified. Which is where Bush left it -- these were exceptional circumstances, it was used, then the door ws closed to it. That seems right to me. Another president at some future date should have the flexibility to re-open that door if the circumstances warrant.
