I'm really confused now. I always thought that when an MM shorts a BB stock without first asking another brokerage to borrow the shares that that is an illegal naked short. MMs could borrow stock, even non-marginable ones, but they at least had to borrow them from another firm. Any other type of shorting is illegal but I realize it is rarely pursued by the NASD/SEC types.
