No one can legaly short a stock without the shares!

Anyone can short any stock ( 1 exception IPO's durring the first 30 days ) if the shares are available at there broker. The reason for most of the conflicting information in this area is that many brokers will not let people short stocks for dif reasons it is the ( your ) brokers rules not the law.

Marginable stocks are created by a list published by the Feds.

Stock buy or sells are settled in 3 days ( you have three days to pay ) options are settled in 1 day ( you have one day to pay ). The reason for conflicting info here is brokers have dif rules of which your credit history may effect.
