Henry, to respond to several of your remarks, first off, if you do a private placement you cannot prevent shorting. So whether it is Swiss or Swiss Miss, it really does not matter. This was a short-term event that raised money for JMAR. A buying opportunity. This will not change the long-term successes of JMAR.

Secondly, it is far easier to apply to the FDA if you are not the first to introduce a device. JMAR will not be the first to get FDA approval for its Light Knife, so it should be far easier to get its application through as a similar device. (Through BD of course).

Regarding FDA application-- I seem to recall that the Lite-Knife is in
"final stages of development". I wouldn't expect application to FDA
until development is complete.
They might not expect difficulty with FDA approval, but I bet it
will take a while, even without difficulties.
