Hey Maurice, I agree that doubt in cases of abuse of naturally acquired monopoly positions (i.e. by beating the pants off the competion with a better product) should be resolved in favor of no goverment action. Strongly agree.

But that's all I agree with. Totally support Justice's positon so far. They will win. Msft will lose. Msft is pushing it too far these days and should stop. They are baiting the smart ass Harvard Law susperstars w/in Justice too far and could get bit. They should settle fast.

The interesting case is Win 98. There I tend to be on Msft's side but am open. If Gates would get off his ego trip he'd slide off this one and save his amo/ Public relations positon for that one.

(Ain't the USA great??? I mean I like to think I'm pretty internationally aware, reading as much out of USA smart stuff on tthe net as I can find. And having lived in England for a year, Spain for half a year, traveled over much of the globe, etc.)

But I think we have the biz of regulating capitalism for maximum gians long term stable gains down pretty well. And not incidentally, regualating it honestly. Relatively.

Why don't we do even better in LT growth rates re: Asia, etc. 1) early development is easier, faster; 2) early development is especially faster when someone/lots of people have already written blueprints as to how to do it/how not to do it; 3) while we have the best creative capitalist (and probably intellectual) classes in the world, we also are cursed with horribly self righteous underclasses; 4) we are curse with the legacy of slavery, as is Brazil and a few other countries, but we as much as any; 5) we are also cursed by an uncritical immigartation policy. While immigration of the talented from all corners of the ethnic world is among America's greatest strengths, a great liability is the mania to let in, whether legal or illegal (made legal after a few years in almost every case) any relative or friend of the most disfunctional members of our society and their most disfunctional and non contributory foreign relatives (who sponsoring relatives are not required to support, that's what Social Security, which typical Americans pay into for 45 year to recieve benefits from, is for).....well all of that is a very distinct drag. Felt in all our major cities.
