You prove my point exactly. Pricing goods below cost to gain mkt share is extremely difficult to prove. The court is either blind or did not have enough information to prove Kodak's case; this alone does not mean Fuji is not involved in collusion/dumping. Why do you suppose Kodak has ~70% mkt share throughout the world except for Japan?, where it is Fuji who has the 70% mkt share?!?! Something stinks here. If you think that Fuji earned it's mkt share w/in Japan IMO you are either kidding yourself or aren't looking at the facts. Within Japan there is a strong "inclination" to do business w/ other Japanese firms. This is not a secret, but the extent of any collusion among Japanese firms is difficult to prove, regrettably resulting in decisions like the one the court handed down.
