They are not independent for this years audit only if they weren't paid for the prior year audit. They can have unpaid billings related to the current year audit and still be considered independent.

Coopers and Lybrand. It also depends on how much and how long payment is overdue I suppose. I know I have paid many bills for audit opinions after they were issued in the normal; course of business you generally do not pre-pay these types of services. (I least I never have).
