There IS an argument that can be made that Marbury was incorrectly decided and should be revisited. Not everyone agreed that it was. I wouldn't criticize anyone, Republican, Democrat, or Other, who questioned the sanity of giving the Court free reign, particularly given its proclivity to build on its own legal precedent which seems a tad incestuous at best and surely has addressed features into the law that should not be there (like the watering down, by the War on Drugs, of the Bill of Rights).
