Of course you're right! That's why Buffett rightfully says his secretary pays a higher income tax rate than he does. You don't think those massive contributions to politicians are based on ideology do you? When you drop over a million bucks on the drum you get to call the tune!

Capital gains must be taxed at a lower rate than ordinary income. It cannot be any other way. But the masses don't understand it; hell, they can't even do their own tax returns.
