There is no positive news on AVANT.

Unless I'm sadly mistaken, the legal morass is widening and the business continues to go down the tubes.

It is rare for a stock to go down (or up) in a straight line. You have to deal with the spikes, burps, and volatility along the way. Take a look at UFEM. You could've shorted at 4 in November, watched it go down to 3 (a gain of 25%) and then rally to 5 1/2 (a loss of 35%). If you would have covered at that point, you would have missed the subsequent drop to 1 3/4.

As long as the story remainds bad or gets worse, the short is still safe. if you are sweating the short term volatility, then you may want to take it easier on the margin.
