The SSM decision is similar to the 1857 Taney decision which attempted to force all the states to recognize slavery. Taney said slave owners could take their slaves into non-slave states and keep them there as slaves. That would in time have compelled the spread of slavery throughout out all the states against the laws of the non-slave states. Just so, the SSM decision imposes SSM nationwide despite numerous state laws and state constitutional amendments banning it.
