I think you're reading more into this filing than is actually there. It looks like standard language in a poison pill, put in to avoid activating the pill if a less than 15% holder happens to get pushed over the line because of a buyback. Not necessarily a signal that CKFR is anticipating a buyback or self tender (the same thing), but that if it occurs the pill is not activated for those already holding some number of shares close to the 15% line.

That's my take.
