There are a number of points you should consider.

1. This is a Policy, not an Instrument. It is a guidance document, not a set of rules. It sets out the regulators' views on the subject, and provides context for Instruments that define disclosure obligations.

2. Look at the date of the document, 2002. The world was a different place then. The internet was not universally available. Mobile devices were not yet internet-enabled. Twitter did not exist.

As I understand it, this guidance is under review. There may soon be other options to material disclosure, other than by press release. We'll see.

3. "Your disclosure policy should prohibit your employees from discussing corporate matters in these forums." And, if that is adhered to, what exactly is your problem?
