No. These are in my IRA so it technically doesn't matter, but I would take the position and rightfully so that I put $xxx in and they expired worthless, just like an option. Anyone at the IRS would have to agree. Or simply take a worthless stock write-off. Either way, I don't believe you have to sell to establish the capital loss. The loss is very very easy to establish....unfortunately.
