Everyone can download NSCP Nav/Commm right now and put it to work on their PC desktop and disable the IE - even Judge Jackson's law clerk knows how to do it.

We have already discussed this argument in this thread, over and over, ad nauseum. Are you just pretending to not have read any of the arguments? Or just don't understand them? Here are a couple of reasons:
1. It still must be installed, and thus takes up disk space,
screen real-estate and possibly memory real-estate.
2. It makes it harder for end-users who want a competitor's
product to justify it to their organizations.

If ms is allowed to give away ie and crush netscape in the process, how much do you think the first ie upgrade after netscape is gone will cost?

If ie has no competition, do you think it will improve at the same rate as if it had competition? Software progresses much faster when upgrades are issued to improve the software over the competetition, not to generate revenue.

Who really needs (or even wants) win98? Win98 is just an excuse for ms to make new upgraded versions of all their software. Without win98, they will have a difficult time growing their revenues in 98.

Are competing software developers aware of the new features that are to be added to the os before it is released? Are they aware of all the new features even after it is released?

The only way to really level the playing field would be to split ms up.

Alot of people seem to be pretty confident that ms will "win". What if they don't? What if they lose and the market continues in the direction it's been going? What if the loss means moving win98 out 6mo or a year? What will that do to their revenue in 98?

Will the outcome of the sun java suit affect win98?

$75 stock price is far from impossible.

What does MSFT's integrated solution have to do with your ability to run a non-integrated product? You post as if this is an if/or situation. It is not. Nothing prevents you from using NSCP Nav or any other OS/browser combination.

It's not about not being able to do it, it's about ms having an unfair advantage. How would you like it if the phone company charged $200 for a new connection but gave you a phone for free?
