The same people who check to see if you violate any other law.

Often no one checks before hand. If evidence of illegal activity comes to light you risk being prosecuted for it, but most people don't have police following them around checking to make sure they do nothing illegal.

back ground checks are required at gun shows. hell if you live in md and go to another state to buy a gun and don't report it to MD you break a Law, if you carry that gun back to MD you break another law, if you carry that gun concealed MD you break two more laws

how many laws do you want

Not just shows - background checks are not always required when citizens buy/sell firearms. Like if you sell a gun to your next door neighbor, or uncle.

Again I repeat - all FFL dealers no matter where they sell a gun must do a background check - period.

Private individuals - aka citizens - must follow their States laws. If their State requires a check then they must seek out an FFL dealer. If there is no State requirement - then they can sell to anyone - unless they are doing so at a gun show that also requires them to use an FFL.

Who checks to decide who must and who doesn't have to?
FFL always run checks, citizens must know their own State laws. Can someone break the law - well of course they can.

back ground checks are the law at gun shows, if you buy one outside the shows it's the same as buying on in a back alley is chicago. there are laws against it so go after the chicago gangs, there are already Laws regarding this
