I think that the point that most of us on the ilk side are making about MSFT's legal maneuverings are that they are attempting to be too clever. So while perhaps they can say, without contradiction, that they are complying, it is clear that they are doing so in a way that is being disrespectful of both the judge and the DOJ. Thus, even though they may even be completely able to justify their responses, it will not sit well with the judge and he may have enough room for coming out with a judgement against them in spite of this.
