I wish I could be on the jury in this case. I would vote to acquit the officer, and I would send a note to him encouraging him to seek damages for wrongful charges against him. I would definitely be onboard with that outcome.

There's nothing there that says first degree... he's going to walk... first degree requires the perp to plan in advance and lie in wait for the victim to appear, all preconceived and planned out in advance, pre-meditated... this case is not the scenario for first degree... how would the officer know in advance that this asshole would show up and was the officer planning and plotting to murder the asshole before the asshole showed up??? There's no way in this world anyone can prove that to be the case, on the face of it, it sounds absurd... the answer is no... so, he'll walk, just wait and see...
