According to my reading of the NYSE rules for managing a remedy during the 'cure period', it isn't relevant to use the closing prices for the previous month's trading, but only for the last trading day. The two criteria to meet are
1. end of month close above $1, and
2. consolidated average (all trades on all exchanges) for the past '30 trading days' is above $1.

We don't have much of a chance for the mid Nov thru the end of Dec period, but the mid Dec thru to the end of Jan period will be our get out of (cure) jail card!
