with no burglary tools and no evidence of attempted entry the shooter would have to suffer through a tedious and detailed investigation before the investigators could determine what happened.
In the case that started this discussion, we are told by a local Texas police force, that the perp was found inside with tools and a gun .... Is that all you need from this case???

If a perp is shot outside while in possession of tools I don't think it would be justifiable homicide in most jurisdictions.. You never heard the advice that if you shoot a guy trying to break in your house, you better pull him all the way in before you call the cops...????
