Smart thought. Can they raise from the ashes. IMO, In theory, if they pay for damages and stay out of jail the optimization algortihms/database are not rocket science and the logic could be re-implemented in a novel way. Don't forget these guys after all used to be an inportant part of Cadence's development engine, their ideas are the proporty of CDN as they exchanged them for a salary and the signing of a confidenciality agrement. Business wise however, I doubt they will get too far with this reputation. I am most intrifued about CDN's actions in terms of reestablishing their development team. As someone in SI mentioned for a variety of reasons (i.e., high valuation, ASian exposure, and lack of personnel resources) CDN may become an excellent short term short candidate after the furor of the January 19 Aquarious injuction pumps up the stock further.

MC the most important asset of a software company is its intellectual capital. I am sure Avant has some good people and their skills will not evaporate with any legal judgement or criminal proceedings. I believe that some of them will form a new company (offshore perhaps) and sell some modified version of the software tools, or possibly, the company may go through a chap 11 proceeding. Either way the existing shares will have little/no long term value after the lawsuits are concluded, in my view. The class action may be weak from the point of view of calculating damages suffered by the class, but it is an excellent piece of legal drafting, and should be required reading for anyone considering an investment, long or short, in this stock.
