Frostman,

What is the source of your information regarding the litigation between HVSF and VVUS in reference to the patent. Is VVUS on record about this litigation, i.e. have they made this public in any of their news releases or SEC filing. I know that HVSF had filed 8-K on October 1, 1997 indicating that through the action filed in the United State District Court in the District of Nevada, the company seeks a declaratory judgment that the method developed and used by the company for the treatment of male erectile dysfunction does not infringe upon claim 6, or any other claim, of the 587 patent. The company also seeking recovery of its costs and reasonable attorney's fees in connection with this action.

Can you elaborate as to who initiated the court action that you have mentioned in your posts, or it is the same one that is filed by HVSF, and what is the status of this litigation.

I own Senetek and HVSF stocks. At one time I also owned VVUS. I am thinking about getting back in VVUS again. I have two specific concern regarding VVUS. There have been several comments made about some sort of agreement between Senetek and Pfizer at Yahoo message Board. If that is correct, this may significantly improve Pfizer's position in ED market. Additionally, the new management at HVSF believes apparently very strongly that their patent situation is extremely strong. If these two items are based in facts, then it may create a very difficult situation for VVUS for long term future.

I apologize If this issue has been discussed on this thread before. In that case I would appreciate if you could please refer me to those particular posts that contain the information on these issues.

Thanks.
