Kennedy was appointed as a compromise candidate after Bork was rejected and Ginsburg withdrew his name. The vacancy that he was nominated to fill came in June of 1987, closer to a year and a half before the next presidential election then a year not in an election year. The current vacancy is occurring less then 9 months before the election.
