Obama needs to adjourn Congress, make a recess appoint, and call Congress back for a new session.

I don't believe the president has any control over congressional schedules. Regardless, they are on recess now so he could appoint someone today. This would actually take all the pressure off the Republicans as the appointment would lapse come next January 20th at noon. I wish Obama would make this mistake but I expect there will be someone with enough brains around him to prevent it. Assuming the Republicans ignore any nominations the upcoming election will likely be a doozy.
