I wasn't positive about the first case. I thought the Court might kill it when Sissel was heard. But I suspect Scalia's death will put an end to it; it was at best a close call and I think it was scheduled to be heard in the coming year.

I do believe Roberts not only joined, but led the liberals on the first case.

It doesn't matter, because the program is collapsing much more quickly than I thought it would. Hell, Obama is having to steal $3.5 Billion just to keep afloat until he can get to Hawaii. The program is effectively on its death bed.
