Well, I agree with most of your post. I would not deny a president a short term ability to get existing data under emergency circumstances, even if it means the use of, e.g., EIT. But you are correct that they will ALWAYS want to expand it.

Perhaps a requirement of a sunset provision could mitigate the problem. But where we stand at this moment is clear cut to me, and I think Apple is fighting a good fight at this moment.

If this isn't stopped here, can you imagine an FBI warrant to Nuance demanding to know what someone said in front of their TV set? It is not that far fetched.
