The last day to trade for regular way settlement in 1997 was Friday. So starting monday, those who want the profits but feared the taxman are clear.

I don't think this is correct. According to the Instructions for Schedule D, "Use the trade dates for date acquired and date sold for stocks and bonds traded on an exchange or over-the-counter market."

It goes by trade dates, not settlement dates.
