A timely ad! Funny thing is that YHOO never traded below 10.

YHOO has been public over a year and a half. This means that initial insiders (VCs for example) could have gotten out. Does anyone know if there are now additional insider shares tied up, for example through acquisitions or additional offerings. If so, timing when these shares are free to be sold may be helpful in projecting a top. Does anyone know?

Re: Constructive sale issue - This question was going to bug me, so I did some research. Found the following in "Overview of 1997 New Tax Laws" (page 101), which I found on the IRS web site.

A notional principal contract is treated as an offsetting notional principal contract results [sic] in a constructive sale of an appreciated financial position if:
- it requires the holder of the appreciated financial position to pay all or substantially all of the investment yield and appreciation on the position and
- gives the holder a right to be reimbursed all or substantially all of any decrease in the value of the position.


Since a Jan or Apr 40 call only protects 40% or so of the downside, I wouldn't think the second condition would be met, ergo no "constructive sale". But then I'm no expert. Consult your tax advisor.
