They've already had such ideas. I was going to use a real world example, but I couldn't find it in a short search, and I didn't want to bother with a long search. So I can't give more detail but - One of the bloggers I read once posted a story about how years ago they where trying to make a claim that (I think) Craig's List was a violation of the first amendment right to freedom of the press, because it deprived them of revenue from classified ads, and without revenue they might not be able to continue to publish.
