Update of my "BNGO Recovery Scenario":

- Darlington acquisition completed. Completed 12/18/97, publicly announced 12/22/97.

- Additional analysts begin coverage. First Research Financial buy recommendation 12/18/97.

- Warrant call successfully completed. Completed 12/22/97, publicly announced 12/30/97. Funds received more than enough to qualify for NMS listing and provide capital for cash acquisitions.

- Acquisitions (in states other than South Carolina) announced.

- Federal judge throws SC "illegal lottery" claim out of court.

- BNGO achieves NASDAQ NMS rating and marginability.

- Institutions, looking to invest in stocks insulated from the "Asian contagion", begin buying BNGO.

- 4th Quarter EPS continues current growth rate.

Of course, the only thing that really matters is how the market treats BNGO, whether or not the items in my scenario come true. Time will tell. So far, everything looks on track (including market response).

I have a little more info regarding the following:

I located the NASDAQ office that handles NMS applications. They would tell me NOTHING about an individual company's application. Not even whether or not one had been filed. I can understand NASDAQ not disclosing financial data presented in an application but you would think they could at least confirm whether or not a application had been submitted. What they could tell me was that turnaround time on application reviews is generally about 6 to 8 weeks. Therefore, I wouldn't expect any news on NMS listing until at least March, 1998. I would urge JTO & Co. to get their NMS application submitted ASAP.

FWIW (and it ain't much) the number at NASDAQ is 202-496-2500 and the analyst who handles BNGO is Hannah Huynh. Maybe if enough "squeaky wheels" call her, she can reduce that 6-8 week turnaround. On the other hand, maybe it would piss her off and she'd drag her heels.
