Yes, but you can't initiate the sale for 14 3/8, if the 14 3/8 bid is lower than the last inside bid. The uptick rule is only on the bid on Nasdaq, but if the bid goes from 14 3/8 to 14 7/16 that's an uptick to me. You can also initiate the trade for anything over 14 3/8 without the bid moving at all, if you can get filled between the spread. BTW, I closed my short this afternoon.
