Eric- I basically agree with you. But when I think of the efforts made by Cabletron to smooth the waters in early 1997 - a CNBC interview with the CEO in front of a fireplace in NH comes to mind - while at the same time not revealing the underlying problems in CS and Levine bailing out to boot - the plot does thicken.

you don,t "get it". The heart of the suit is did the common stock become artifically inflated during this period seems to be the issue.
Did BENSON, kIRKPATRICK AND DUNCAN have access to non public information? They were selling at the times the smart switches, moneymakers, were not available and telling us there were no problems. This is not the same as having a poor performance that was unanticipated.The small investor, and the investment community invests with assimilating knowledge it recieves. So much for gene pools.
