Want To Help Trump? Sign This One-Sided 2,317-Word Terrible Agreement

Online volunteers wanting to help Donald Trump will find the fine print a bit daunting. The “Red Dialer” online non-disclosure agreement is a 2,317 word, 10-paragraph document that, among other things, requires volunteers to agree “not to demean or disparage publicly the Company, Mr. Trump, any Trump Company, any Family Member, or any Family Member Company or any asset any of the foregoing own, or product or service any of the foregoing offer.”
There are typically two ways to officially volunteer to help a candidate: walk in to an office, or sign up online. Unless you live in Virginia, Ohio, New Hampshire, Pennsylvania, Wisconsin, Iowa, Colorado, Arizona, Nevada, Georgia or Florida, you’re totally out of luck because Trump has zero offices outside those states. Only in Wisconsin, Ohio and Virginia does Trump has 10 or more offices. Florida has only one.
For most people it’s online. And to the strict agreement. Here’s some choice excerpts:
Until the Non-Compete Cutoff Date you promise and agree not to assist or counsel, directly or indirectly, for compensation or as a volunteer, any person that is a candidate or exploring candidacy for President of the United States other than Mr. Trump and to prevent your employees from doing so.
If you have a company, note that “prevent your employees” clause. It’s likely unenforceable on them, but that doesn’t mean Trump can’t sue you if one of your people volunteers for Hillary. And he probably would sue you.
Oh, and the agreement is forever.
During the term of your service and at all times thereafter you hereby promise and agree not to demean or disparage publicly the Company, Mr. Trump, any Trump Company, any Family Member, or any Family Member Company or any asset any of the foregoing own, or product or service any of the foregoing offer, in each case by or in any of the Restricted Means and Contexts and to prevent your employees from doing so.
Six years from now, remember this if you decide you don’t like Trump (or his company, wife, kids, et al.) anymore and write that on Facebook.
And you can’t escape by quitting if you work for one of Trump’s companies or one of his contractors.
This agreement will survive the expiration, cancellation or termination of any employment or independent contractor relationship that you may have with the Company or with any individual, entity, partnership, trust or organization that the Company has engaged.
If you don’t like the agreement, you are limited to arbitration, but that doesn’t mean Trump can’t sue you. It also grants Trump injunctive relief, indemnification, unlimited damages, and basically every single thing all the corporate lawyers I’ve ever worked with have told me are the worst red flags in any contract. I am absolutely certain that any of them would tell me “do not, under any circumstances, sign this” if I placed it in front of them today.
It’s a truly awful and completely one-sided agreement that nobody should sign. But if you want to volunteer for Trump, that’s what you have to do.
Because Trump is a truth-teller who fights for us and won’t have it any other way.
