01/01/98 Nikkei Net Daily News

TOKYO (Nikkei)-Bankers Trust will set up as early as February a company to purchase and recover nonperforming loans held by Japanese banks, bank sources said. The financial institution intends to take advantage of its extensive U.S. experience in similar operations.

The subsidiary will start with a team of about a dozen collection specialists to handle foreclosures, repossessions and other recovery steps. Bankers Trust expects to profit by purchasing hundreds of billion of yen worth of bad loans at a discount from Japanese banks.

In Europe and the U.S., collectors receive commissions for their services, but in Japan only attorneys can collect on behalf of another party. The Liberal Democratic Party intends to pass a law recognizing the establishment of collection firms on condition attorneys serve as company directors.
