Re -- all members of a given creditor class are paid pro rata out of liquidation proceeds.

The key is creditor class is. Are banks which underwrite some of the debt in the same class as Nusance?

The point is though, in the case of bankruptcy, lawyers will have a field day, and it will be years before any proceeds are delivered.

Nusance in all likelihood, will get pennies on the dollar.
