Pongo- I saw the Kernan interview which basically stated "I want one in blue". The CNBC interview I was referring to was one in the Febr-March period from NH with fireplace in background. COMS stock was crashing from both Intel price cuts and fear of major slowdown in switching. Levine basically calmed the waters and said everything for CS was coming up roses. This shortly preceded the run up to 45 and then the collapse to 30. I think Levine was selling throughout this time period.
I'm not really sure why you require a conspiracy among all networkers for this to have held up CS stock. As I recall, COMS dropped much more than CS and CS stabilized in the 30 area. I also recall assurances from the company that the componenent shortage was over in Sept. Apparently not - or at least we are lead to believe that the recent shortage was simply "failure to close a few big deals".
I'm basically skeptical of these stockholder suits but I did buy this company thinking that the large ownership by these officers would protect shareholders. My conviction isn't as strong on this score as it once was. I hope you are right though that Benson's ownership keep officers aligned with the interests of shareholders.

good post, but why confuse the issue with facts? ;-)

Imagine yourself as a lawyer trying to drum up some more suckers, oops - I meant clients, to pay for your new Benz, extended vacation, homes, etc. CS stock price fell - thus it's an opportunity for those devoid of any scruples to make another buck off the back of the individual shareholder. ... all the while, smiling and telling them that the lawyers are there to help.
