I think it was sheer luck for them that Vivus moved equipment and cut production by 25% at a time when S.Korea tanked!!!

The shorts WERE right about this stock (as was I), riding it down from 42 to 20. On this most recent drop, however, the shorts were mostly lucky except in one regard --- they still knew that management was aware beforehand about production problems and that they've been less than honest with shareholders about their magnitude.

Despite all the recent optimism, I believe some bad production news is still forthcoming. IMO, I don't believe we've seen the bottom yet.

Does anyone know the number of shares being shorted as of today (post year end)? Is it still 10 million?
For three months prior to the big drop the shorts were buying in the face of all positive hype. I'd like to know if any of the analysists who were hyping Vivus were shortimg it in the background. They must have know that bad news was comming. We are now past year end and they do not appear to be covering and I don't understand. They must fel very positive that there is more real bad news in the works otherwise what are the percentages. Why not take the profit rather than risk trying to get another point or two. I would appreciate any thoughts on the possible thought processes of the shorts.

It seems to me that there are only two bits of news left that could push this stock lower:
1- Vivus's patent does not hold up.
2- 4Q numbers are even worse than projected. As I recall, the CC only talked about "25% lower revenues". I don't think that EPS were mentioned, could they be even worse?

Does anyone have any information on either of these two items?
