How could they? They at least claim they need a warrant to look. Maybe they are lying. Maybe not.

As a result, they don't even know if they already have those email. Or if any aren't duplicates.

There is no way to know at the moment.

Fact check: no, the FBI is not ‘reopening the investigation into Hillary Clinton’s email’

On Friday afternoon the internet became ablaze with hype and fear after a number of major news outlets reported that the FBI was ‘reopening the investigation into Hillary Clinton’s email’ or some other similarly worded claim. But even as wild speculation and conjecture overtook the political sphere, the actual letter from FBI Director James Comey makes clear that the above is simply not true. Some news outlets are already walking back their original breathless and deeply exaggerated initial reporting.

Comey himself has confirmed that this is an “unrelated case” and he’s admitting that it may not be “significant.” Because the Republicans in Congress had demanded that he inform them if anything new surfaced that was even tangentially related to the now-closed Hillary Clinton email investigation, he was legally required to send this letter. But officials are already confirming that the emails in question did NOT come from Hillary Clinton’s private email server (as reported on-air by CNN at 3:30pm EST Friday). In fact the network’s sources say this is a result of the investigation of Anthony Weiner, meaning that it has virtually nothing to do with Clinton. Most importantly, the FBI is not reexamining any of its previous findings in its now-closed investigation of Hillary’s email server.

That hasn’t various news outlets from trying to paint this as a nuclear bomb which will sharply alter the course of the 2016 Presidential election. But that also represents opportunistically false reporting on their part. Because this is a minor coda to a long-ago-settled email controversy that virtually all Americans have already made up their mind about, this is unlikely to impact a single vote – particularly as it’s come so late in the process.

Everyone who was planning to vote for Hillary Clinton will certainly still do so. Those who consider this new story to be important enough not to vote for her are the same people who were already planning to vote against her. The most likely outcome of this story is that Clinton will become President by the same margins she’s currently leading in the polls, and that Comey himself will become a target of investigation for his role in trying and failing to sabotage a Presidential election at the last minute.
