Many (can't say if it's "most") states have statutes or case law that severely restrict the scope of a non-compete for non-management personnel.

I like seeing temp companies put non-competes in their contracts, supposedly justified on the "trade secret" grounds. Trade secret what? Don't tell the employer they employ you? Not worth the paper it is written on.

Agree with you on non-compete clauses, but have almost never seen them enforced.

If it is a buyers market, that is simply a function of supply and demand in a crappy economy. For people with the right skills, it is very much a sellers market.

Not true....its part of the consideration for the employer offering the job in the first place...
