No...that's not what he said....he added an element to the offense which does not exist in the statute as written....and his statement that no reasonable prosecutor would seek an indictment is clearly wrong...as evidenced by a number of experienced prosecutors who took issue with that statement....

In any event, an objective view of the facts does inevitably lead to the conclusion that the law was violated.
